1. Introduction

Welcome to HotelMentor.AI („we,” „our,” or „us”). These Terms of Service („Terms”) govern your access to and use of the HotelMentor.AI platform, including our website (https://hotelmentor.ai), dashboard application, AI-powered chatbot services, and Facebook Messenger integration (collectively, the „Service”).

By accessing or using our Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

2. Description of Service

HotelMentor.AI is a hotel management and customer service automation platform that provides:

– AI-powered chatbot for guest communication via website widgets, Facebook Messenger, and voice channels

– Customer support ticket management

– Knowledge base management

– Newsletter and marketing tools

– Task and workflow management for hotel operations

– Real-time guest communication monitoring and response

3. Account Registration and Security

3.1. You must register for an account to access the Service. You agree to provide accurate, complete, and current information during registration.

3.2. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

3.3. You must notify us immediately at info@hotelmentor.ai of any unauthorized use of your account.

4. Acceptable Use

You agree NOT to:

a) Use the Service for any unlawful purpose

b) Send spam, unsolicited messages, or bulk communications through the chatbot or messaging features

c) Attempt to gain unauthorized access to any part of the Service

d) Upload malicious code, viruses, or harmful content to the knowledge base

e) Impersonate another person or entity

f) Use the AI chatbot to generate misleading, harmful, or deceptive content

g) Violate any applicable laws or regulations, including GDPR and data protection laws

5. Facebook Messenger Integration

5.1. Our Service integrates with Facebook Messenger via the Facebook Graph API to enable automated customer communication for your Facebook Page(s).

5.2. By connecting your Facebook Page, you authorize HotelMentor.AI to:

– Receive messages sent to your Page via Messenger

– Send automated responses on behalf of your Page using AI

– Access basic profile information of users who message your Page (name, profile picture) for personalization

5.3. You are responsible for ensuring your use of the Messenger integration complies with Facebook’s Platform Policies and Messenger Platform Policy.

5.4. We only process messages initiated by end users. We do not send unsolicited messages or promotional content via Messenger without user consent.

6. AI-Generated Content

6.1. Our Service uses artificial intelligence to generate responses to guest inquiries. While we strive for accuracy, AI-generated content may contain errors or inaccuracies.

6.2. You are responsible for reviewing and monitoring AI-generated responses, and for configuring appropriate system prompts and knowledge bases.

6.3. You may take over any AI conversation at any time through the operator takeover feature.

7. Data Ownership and Intellectual Property

7.1. You retain ownership of all content you upload to the Service, including knowledge base documents, system prompts, and guest data.

7.2. We retain ownership of the Service, including all software, algorithms, design, and documentation.

7.3. You grant us a limited license to process your content solely for the purpose of providing the Service.

8. Privacy and Data Protection

8.1. Our collection and use of personal data is governed by our Privacy Policy (https://hotelmentor.ai/privacy-policy/).

8.2. We process data in compliance with the General Data Protection Regulation (GDPR) and applicable Hungarian and EU data protection laws.

8.3. Data is stored within the European Union (Frankfurt, Germany region).

8.4. You are the data controller for guest data processed through the Service. We act as a data processor on your behalf.

9. Service Availability and Support

9.1. We aim to provide 99.9% uptime but do not guarantee uninterrupted access to the Service.

9.2. We may perform scheduled maintenance with reasonable advance notice.

9.3. Support is available through the in-app help system and via email at info@hotelmentor.ai.

10. Subscription and Payment

10.1. The Service is provided on a subscription basis. Pricing details are available at https://hotelmentor.ai/araink/.

10.2. Subscriptions renew automatically unless cancelled before the renewal date.

10.3. Refunds are handled in accordance with applicable consumer protection laws.

11. Termination

11.1. You may terminate your account at any time by contacting us at info@hotelmentor.ai.

11.2. We may suspend or terminate your account for violation of these Terms, with reasonable notice where possible.

11.3. Upon termination, you may request export of your data in accordance with GDPR data portability rights.

12. Limitation of Liability

12.1. To the maximum extent permitted by law, HotelMentor.AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.

12.2. Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

12.3. We are not liable for any actions taken based on AI-generated responses.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or in-app notification. Continued use of the Service after changes constitutes acceptance.

14. Governing Law and Dispute Resolution

14.1. These Terms are governed by the laws of Hungary.

14.2. Any disputes shall be resolved through the courts of Budapest, Hungary, unless mandatory consumer protection laws require otherwise.
